A Wife’s Appeal for Justice

I am the wife of Mohammad Afzal, the man accused of conspiring to attack the Indian Parliament on December 13, 2001. Afzal has been condemned to death by the Sessions Court Judge, S N Dhingra and his death sentence has been confirmed by the Hon’ble High Court of Delhi. Now the case has come up before the Hon’ble Supreme Court of India.

All over India people have condemned the attack on Parliament. And I agree that it was a terrorist attack and must be condemned. However, it is also important that the people accused of such a serious crime be given a fair trial and their story be fully heard before they are punished. I believe that no one has heard my husband’s story and he has so far never been represented in the court properly.

I appeal to you to hear our story and then decide for yourselves whether justice has been done. Afzal and my story is the story of many young Kashmiri couples. Our story represents the tragedy facing our people.

In 1990 Afzal was attracted to the movement led by the JKLF, like thousands of other youth. He went to Pakistan for training and stayed there for a little while. However, he was disillusioned by the differences between different groups and he did not support pro-Pakistani groups. He stayed there only three months without getting any training. Afzal returned to Kashmir and he went to Delhi to pursue his studies. He always wanted to study and before he joined the movement he was doing his MBBS.

My husband wanted to return to normal life and with that intention he surrendered to the BSF. The BSF Commandant refused to give him his certificate till he had motivated two others to surrender. And Afzal motivated two other militants to surrender. He was given a certificate stating that he was a surrendered militant. You will not perhaps realise that it is very difficult to live as a surrendered militant in Kashmir but he decided to live with his family in Kashmir. In 1997 he started a small business of medicines and surgical instruments in Kashmir. The next year we were married. He was 28 years old and I was 18 years.

Throughout the period that we lived in Kashmir the Indian security forces continuously harassed Afzal and told him to spy on people they suspected of being militants. One Major Ram Mohan Roy of 22 Rashtriya Rifles tortured Afzal and gave him electric shocks in his private parts. He was humiliated and abused.

The Indian security forces used to regularly take Afzal to their camps and torture him. They wanted to extract information from him. One night the Indian security forces came to our home and abused all of us and took away Afzal to their camp; another time he was taken to the STF (State Task Force) camp Palhalan Pattan.

Some days later they took him to the Humhama STF camp. In that camp the officers, DSP Vinay Gupta and DSP Darinder Singh demanded Rs one lakh. We are not a rich family and we had to sell everything, including the little gold I got on my marriage to save Afzal from the torture.

Afzal was kept in freezing water and petrol was put into his anus. One officer Shanti Singh hanged my husband upside down for hours naked and in the cold. They gave electric shocks in his penis and he had to have treatment for days.

You will think that Afzal must be involved in some militant activities that is why the security forces were torturing him to extract information. But you must understand the situation in Kashmir, every man, woman and child has some information on the movement even if they are not involved. By making people into informers they turn brother against brother, wife against husband and children against parents. Afzal wanted to live quietly with his family but the STF would not allow him.

You should also know that the STF force is notorious in Kashmir for extorting money from the people and they have become so infamous that when Mufti Sayed became the Chief Minister he promised in his election manifesto to disband the entire force. The STF is known for human rights violations including killing people in their custody and brutal, senseless, inhuman torture.

It was under these conditions that forced Afzal to leave his home, family and settle in Delhi. He struggled hard to earn a living and he had decided to bring me and our four-year old son, Ghalib, to Delhi. Like any other family we dreamed of living together peacefully and bringing up our children, giving them a good education and seeing them grow up to be good human beings. That dream was cut short when once again the STF got hold of my husband in Delhi.

The STF told my husband to bring one man Mohammad to Delhi from Kashmir. He met Mohammad and one other man Tariq there at the STF camp. He did not know anything about the men and he had no idea why he was being asked to do the job. He has told all this to the court but the court chose to believe half his statement about bringing Mohammad but not the bit that he was told to do so by the STF.

There was no one to represent Afzal in the lower court. The court appointed a lawyer who never took instructions from Afzal, or cross examined the prosecution witnesses. That lawyer was communal and showed his hatred for my husband. When my husband told Judge Dhingra that he did not want that lawyer the judge ignored him. In fact my husband went totally undefended in the trial court. When ever my husband wished to say something the judge would not hear him out and the judge showed his communal bias in open court.

In the High Court one human rights lawyer offered to represent Afzal and my husband accepted. But instead of defending Afzal the lawyer began by asking the court not to hang Afzal but to kill him by a lethal injection. My husband never expressed any desire to die. He has maintained that he has been entrapped by the STF. My husband was shocked but he had no way of changing his lawyer while being locked up in the high security jail. It was only after the High Court judgement was pronounced he got to know about the way the lawyer had represented him. Afzal refused to accept the same lawyer for his appeal in the Supreme Court. I had no way of getting Afzal a lawyer. I do not know anyone in Delhi. Finally Afzal wrote to the Defence Committee set up for Mr Geelani. I am annexing his letter. And the Defence Committee helped Afzal to get a senior lawyer, Mr Sushil Kumar. However, the Supreme Court cannot go into the evidence and so I do not know what will happen.

I appeal to you to ensure that my husband is not condemned to death and he is ensured a fair trial. Surely your conscience will not allow you to be a party to the death of a fellow human being who has not been represented in the court and who has not had a chance to tell his story? The police have made him falsely confess before the media even before the trial started. They humiliated him, beat him, tortured him and even urinated in his mouth. I feel deep shame to talk about these things in public but circumstances have forced me. It has taken a lot of courage for me to put all this on paper but I do so for the sake of my child who is now six years old.

Will you speak out at the injustice my husband has faced? Will you speak out on my behalf? I am of course fighting for my husband’s life, for the life of my son’s father. But I also speak as a Kashmiri woman who is losing faith in Indian democracy and its ability to be fair to Kashmiri Muslims.

  1. Why was the contents of this letter not made public so long? Indian Judiciary, with all its shortcomings, is still capable of delivering fair justice & is very unlikely to make a gross mistake in such high profile cases. I seriously doubt whether the letter was ever seen by the judges & the veracity examined. Or was it that post investigation, facts turned out to be very different. Hope time will tell.

    • The appeal was published in Kashmir Times and Asian Age, in 2004, before the verdict and a written statement by Afzal Guru revealing the same story was not treated admissable by the court

        Should that not have been investigated rather than believing good intentions of STF??

      • Ask the STF why they asked him to do so. Tabassum is only writing what happened to them. Can’t you sense the innocence in it? A cunning woman would have also put up the reasons why STF asked Afzal to do so because she would know people would question the veracity. Put yourself in her shoes. If you have seen bollywood movies of such genre/storyline it would be helpful.

    Today it may seem pointless to ask whose truth does one believe? The government of India’s, the court’s or Tabassum’s? We should have asked this yesterday when he was on trial. Whatever be the spoken or the unspoken story this appeal of a woman/wife/mother affects me and the narrative of my own life.

  6. This is the usual emotional garbage every terrorist/ mass murderer family tries to sell. Let us not get carried away. Her husband was responsible for one of the most henious attacks in the history of Independent India. He did not deserve any rights and rightly was hanged without any prior notice. His plea was considered at length and by the by he himself had confessed in a TV interview.

      please understand the point Md. Afzal’s wife is trying to make. She was asking for a fair trial. She was not asking her husband to be let scot-free.
      Also, the atrocities of the police and other forces in J&K is well known. So the instances she had disclosed of the torture may well be a truth, and hence condemnatory.
      Finally, the poor people face problems in getting justice because of their inability to appoint good lawyers. If indeed the trial had gone the way mentioned in this letter, then it will really be a sad day for this democracy, since even the judiciary will also have failed us.

    • If Afzal was must hang prisoner well there are more than 100 prisoners who has similar or more serious offences and MUST be hanged too within next 2 years that is what your senior lawyers said in the recent debate.

      Is INDIA really going to hang another 100 offenders ??

            Yes he did the blunder of joining militancy and ruining his medical career. But his allegation that he was coerced by STF (or someone feigned as STF) must be probed for sake of nation and for sake of humanity. We must wish and help Kashmiris to get modernized and integrated with nation and rise in life. We must be considerate towards bereaved family. There are some unfortunate Indians in Pakidstan prisons too, we must try for their release and mercy upon them. No law or nation can be good without mercy, so clearly wrote by Shakespeare.

        Does anyone remember that roundabout 1960, the Parliament was surrounded and attacked by trishul wielding sadhus demanding ban on cow slaughter? Was that possible without some organization and mastermind ? Perhaps Home Minister Gulzari Lal Nanda was himself involved. The allegation that STF pressed Afzal to help Mohammad and purchase car must be thoroughly probed to prove or disprove possibility of Hitler-devotees of India! Even if Afzal was mastermind, we can not be harsh towards aggrieved family. I am against violence and terrorism and against secession. I believe Kashmiris develop themselves sociio-economically and call back Kashmiri Hindus. The secessionists and Hitler-loyalists both are enemy of nation.

  9. There are two Issues to this. first one is….ask any muslim if he is an indian first or a muslim first? He will say he is muslim first. They grow up giving more importance to their communal identity than to their nationalistic identity. And hence get carried away into all those communal propagandist means like going to Jamaats where they are brainwashed that anyone or any place ‘Unislamic’ must not be allowed to exist. Afzal was one such victim. We have no problems with Kashmiri muslims who are pro-pakistan or pro-anywhere else. They are free to leave and migrate to where ever they want to. BUT WHY ASK FOR THE LAND? THE LAND IS INTEGRAL PART OF INDIA. Those who have a problems with the idea of india/ indianess/ india’s secular democratic ethos, they may leave the country and go where ever they want to. No one is stopping them. The problem arises when communally brainwashed people demand separate statehood and think they are some great exclusive lot. Kashmir is the land of the great sarasvathi Peetham and scholars like Kalhana and Bilhana. Scores of Kashmiri Pundit families have more gory stories to tell. Going by history, can these people also reclaim their ancestral land? Who does it belong to? the ancient citizens of the land and their descendants or the invaders and their clergy and whoever else? What about the mass exodus of scores of Kashmir pundits who had to flee their homes over night? HOW COME THOSE STORIES DON’T GET PUBLISHED??

    If this is a fair trial and democracy, why doesnt someone speak for the lakhs of Kashmiri Pundits who were either forced into religious conversions or made to flee the land with threats of all kinds? How come their pain and stories are any lesser? How is ignoring their agony any less or more democratic?

    Yes the Indian courts are the worst-organized. They take ages to clear cases and most times give faulty judgement. I agree that a fair trial should have been given to Afzal but hey! when you are too busy asserting your religious and communal identity, how come your god/religious leaders didnt come and intervene? Sorry to say but this case must serve as an example for everyone who wishes to be against the idea of INDIA AND INDIANESS AND DOESN’T RESPECT THE SECULAR DEMOCRATIC ETHOS OF THIS GREAT LAND!

      About Kashmiris , it is not just about the pandits who hv suffered over the years and muslim enjoy the best of the life in Kashmir . Had this been the case than most of the Muslims from other communal and sensitive parts of the country wud have moved to Kashmir by now . Many Muslims have also migrated out of J & K to have a better life . I met a Kashmiri muslim at Mumbai airport few years back and heard about the life they lived in kashmir as a kashmiris . As a kid to play on the playground was like a fairy tale dream for him . While he go to school , his parents were never sure if he will come back alive every day . They have lived in the shadow of terror and threat every moment . Respect !!!!
      Unfortunately both Indian and Pak govt are not interested in Kashmiris but just a mere land and to keep Kashmir as the most hot and burning issue for all electoral campaigns in both countries .

      Try to have a heart of a Human and mind of an Indian !!!! Humanity is beyond boundries ……

Well It’s fine that Indian don’t believe on these real stories because they have just seen these type of situations in movies or in news..Tell me what happen to those which they know from the beginning of there mature life…like Nerinder modi who has killed many Muslims in Gujarat for the sake of his seat in Gujarat .wht about narsima Roy who has demolished Babi masjid for the sake of his polutics…what happen to kalmadi who has Been involved in the corruption of 600 chores …what happen to Indian troops who had killed tufail mattoo in 2008 he was just 15 year old and he was hanging his school bag and watching cricket match in local ground he was not terrorist……what happen to those who had raped two innocent girls Nelofer and Asiya in shopian Srinagar…what happen to those who had killed thousands of innocents in Srinagar for the sake of there medals……

  11. Banana! You cannot justify terrorism by saying it is a general thing. “Hey everybody was doing it so I did it.” That is not an excuse. We are Indians. You know what that means? that your country is your mother. And if anyone be it your own brother, parents, children or any other relation tries to violate the peace and integrity of the country then those relations should be cut.

    The STF may be inhumane to the country men{which Police is not. Take any example UP, Bihar. They put Acid in people’s eyes} but no matter who you are I will not believe that STF participated or facilitated the parliament attack{I mean what is the point they are trying to take over the country??}. This report is published after death of Afzal. And hence I will not believe anything said above as this report could have easily been published when he was alive{And they kept him alive for a long time}. So why this is being published now??? Coz some report wants to cash in on sensationalism.

    I wanna hear counter vies on this. Everyone is invited. By the way I am not anti islam or pro hindu. I am an atheist. And I believe everyone has right to live{As long as you never helped any terrorist.}

    Uncanny similarity in content and chronological order of anecdotal facts in this letter and the link in my comment (which was an interview of afzal in jail). We have to take everything with a pinch of salt.
    Which brings the next thing. How is it that one of the accused goes scot-free while the other is hanged? Is just one person enough to orchestrate a high-profile terror attack? Nothing is black and white in reality, everything is a shade of grey, and our laws should reflect that. I personally feel that we HAVE to do away with the death penalty. And that is why, his hanging is a step backwards.

  13. Ok. Everything accepted. But…If he was innocent and not linked even remotely to anything to do with terrorism why is he being considered a Martyr by the Lashkar and likes? If he was not close to Pakistanis why are they so bothered? The country did not even try to claim the body of their confirmed citizen when he was hanged a couple of months back and now they are going berserk about avenging the death of an Indian Kashmiri? As for the Kashmiris…if they think separatists are ruining their world, why do they time and again get enticed by such stories that they know are going to end in such devastation.     The moot question is – was Justice done in liquidating Afzal Guru or are we to believe the emotional rhetoric of his wife and garner pity for a poor innocent being framed for a crime he didn’t commit.

    To all the socialites whose heart have melted between the mellufluous rhetoric of Afzal Guru’s wife let me get back to you with some facts from his own admission.

    Here’s the thing guys, that’s not exactly how things play out with military training or terrorist indoctrination anywhere in the world. This I say from my years in the Military and service in J&K. Training as a terrorist is a one-way door and include hardships, which in cases, are almost as demanding as conventional military training. It’s naive to think that you can just walk in and walk out. Not your fluff-candy college education…So what really happened and how did he manage to get back. There was no disillusionment here. Just like in any other conventional military training you get kicked out when you turn out to be a sisi, Afzal must’ve been found wanting of the standards required for armed militancy. So he never actually makes it beyond the base camp and the Pak recruiters dump him, for he’s of no value to them either. So effectively we know where his heart was – right?
    So what does a guy do as a failed militant. And here’s the deal, Afzal isn’t the only one who played this trick – go back to the Indian Army and surrender for a prize money and promise information. Contrary to the belief that you conjure about a brutal Indian Army, full of rapists and psychos, the Army actually pays these losers up and provide them support to set up a craft suitable to his skill-set. It also offers free education and training to a surrendered militant’s kids and family. And unlike the rhetoric that you just read, which has no veracity, if you dig hard enough, you’d find documentative evidence of the Army psy ops.
    I guess I’ve driven a point home if you care to go by the logic.

    Let’s break a few more notions…..here I quote a few more lines from the article.

    What is this paragraph supposed to mean. By her own admittance Afzal had information about treason or he had direct terror links in the family -”brother against brother…” I hope your soft socialite hearts have not eluded you to believe forget the fact that – aiding and abetting terror is an act of treason and carries a life in prison.
    So by her own admittance Afzal Guru committed treason and deserved a life in prison in any case.

    One last point, nowhere does this article mention about the critical piece of evidence in this case – the laptop that was seized from Afzal and connected him directly to the crime. Why does the rhetoric choose to remain silent on the most critical piece of evidence and cry foul about Afzal not getting fair jurisprudence.

    C’mon guys it’s the tax-payer’s money that goes into appointing a counsel for the accused. I would like to see my tax contribution put into better use. And for Afzal – do you really believe he ever actually paid a dime of tax ???

  20. With all due respect to the fellows who are commenting here, there are some insanely stupid people on this forum who are passing judgements based on a letter on a website “IndiaResists.com”. Man, I can’t believe how and why is everybody gung-ho over a piece which is not even verified by anybody.
    Now about Kashmir and et al. I am a Kashmiri Pandit myself. So when a Muslim here shouts in between that they welcome Pandits with open hands, that my friends is a fallacy, if we care to consider what happened in the past. When they forced all the Pandits to exile, and took over all the land, nobody cared to raise a voice. When nobody took cognizance of the fact that Pandits were made to go for an exodus, nobody even spoke.

    Here is my take on Afzal. The case was taken forward according to the Indian judiciary, and was pending since years together. If we as a country cannot trust our judiciary, and believe an “amazingly written piece of English”( which I am in doubts after hearing Afzal’s and his wife’s english standards on a TV channel), then I believe we should turn to Pakistan for our exile. It is only there, that the judiciary punishes the Prime Minister, and the person responsible for the arrest refuses. Failed country, damn !

    For the brashed on STF, I agree that even if the letter is true, and everthing that is written did happen – i.e, Afzal was tortured, his family tortured and everything else then why was this guy Mohamed brought into Delhi? Is this because our own security forces planned to attach the parliament, so that the army may take over India. I am sorry, dimwits, that is not how it happens in India. If ever, somebody can have such intentions is only with the mentality of a state like Pakistan – where Musharraf’s take over the government in military coups etc.

    I am sure by now many of you would realize that it is not the letter which is the only string in the case, and that we start measuring the accountancy of the attack. Muslims in Kashmir are today facing the same havoc what they raised back in 1990 in the name of their Pakistani brethren. Unfortunately what goes comes back. This I am not saying in the feeling of hate or malaise towards them. It is the failed state of Pakistan that is responsible behind propagating cases, whenever there were. And those who are crying over unfair justice, I would like to tell them that they were probably in long sleep when all the case was being heard through 12 years. What you call unfair is what happens in Pakistan, and Saudi, that you pick up a toffee, and your hands are cut. I, at the end, am not passing any judgments, since that is the sole entitlement of easily misled people of India. Its again an open debate.

    How many stories have you heard of families affected by terrorism? Afzal is gone. May you find the strength to make peace with it. He never was a hero so do not make him seem like one.

    1)What happens to the 300,000 Kashmiri Pandits who got FORCIBLY displaced,killed and raped from their home land Kashmir.and living in camps in Delhi and elsewhere.

    2)Who is going to answer for the several policemen and the gardener,who got killed in the Parliament attack.

    3) Is it a figment of the world ok Indians imagination,that Pakistan does not conduct proxy war in Indian Kashmir,Tabussum said her husband went to Pakistan for training. Why??

    Just keep one thing in mind: Afzal was a surrendered Kashmiri, and he was in and out of the Indian STF, and he was under constant monitoring by STF & Indian intelligence agencies.

    Will any terror outfit contact or assign a terror job to a surrendered militant who is under constant supervision?

    Arundhati Roy wrote an enlightening letter way back in 2005, raising many thoughtprovoking questions and a good account of the police and STF excesses and the injustice of the Judiciary. Patriotism is not blind support to our governments, rather questioning government over matters of significance, how great they may be.

    The then BJP government head AB Vajpayee was constantly talking about the possibility of an attack on the parliament, months before the actual attack. Even just a day before the attack, he stated in parliament citing intelligence reports of an attack on our parliament. Subsequently, security was heightened at the parliament. How then the five men with guns and a car loaded with explosives pass through security?

    Afzal was nowhere in the picture before or after the attacks. How then did the police zeroed in on him and SAR Geelani, within a matter of days !!

    If you think government’s can’t plan FALSE FLAG OPERATIONS (terror attacks included), then you should do some research. For example, 9-11 was one such tremendous false flag operation and so “Operation Northwood”. Supporting the lies of any government is not patriotism,but standing against it is.

    All that Afzal and his wife asked for was an impartial and fair trial. Hang him if he was found guilty after a fair trial and all angles have been investigated. It was in the interest of India’s security that the case was investigated properly.

    Even the Supreme Court’s justification to hang him “to satiate the collective conscience of the society” is a shame on Indian Judiciary and Government. By this analogy, Narendra Modi shouold have been hanged to satiate the collective conscience of the society.

    To us, Bhagat Singh is a “shaheed” and a freedom fighter, but for the British, he was a “terrorist”. Afzal was a shaheed and a freedom fighter for Kashmiris against Indian occupation of Kashmir. Perhaps Afzal’s greatest mistake was he trusted India and surrendered to the STF, thinking he would live a normal life. I wonder if any Kashmiri would ever think of surrendering after Afzal’s story.
